YOGA RETREAT TERMS AND CONDITIONS

Your contract is with Elizabeth Dipre.

Your contract will incorporate these Yoga Retreat Terms and Conditions (“Terms and Conditions”). It is therefore important that you read carefully, the following Terms and Conditions as these will form the basis of your contract.

Please also see the ‘Additional Info relating to COVID-19’ for the health and safety measures you can expect on our yoga retreats.

We strongly advise and require that if you make a booking on our yoga retreats that you obtain individual travel insurance that includes “cancel for any reason” within the policy as well as cancellation and medical cover for COVID-19 related incidents.

Interpretation

1. Reference to “you”, and “your” means the persons named in the booking (including any person added or substituted subsequently.

2. “We”, “Us”, “Organiser” and “Our” means Elizabeth Dipre, the organiser of the yoga retreat.

3. Reference to “retreat’ means the services we have agreed to provide or provide you with under your booking with us. Full details can be found at https://www.hightideyoga.com/portugal-retreat

4. References to “Retreat Start Date” means the start date of the yoga retreat you have booked a place onto as published at https://www.hightideyoga.com/portugal-retreat

5. A reference to “in writing” refers to email only. The email should be sent to Elizabeth Dipre at hello@hightideyoga.com

1. Booking

(a) Your booking shall only be deemed to be accepted and a contract in existence, once when we have received cleared funds of a £400 deposit from you. The amount of deposit payable will be confirmed in a PDF ‘Retreat booking details’ sent to you by email, upon receipt of your enquiry of making a booking onto the retreat.

(b) The contract incorporates these “Yoga Retreat Terms and Conditions” which are governed by English law and the jurisdiction of the courts of England and Wales.

(c) All notices and communications regarding this contract should be sent by email to hello@hightideyoga.com.

(d) We reserve the right to refuse to accept bookings in our absolute discretion without stating the reason for doing so.

(e) We will not share your personal details provided with any third parties.


2. Payment

(a) The price stated in the ‘Retreat booking details PDF’ for your booking is the exact amount to be received by us in GBP. If you are paying in any other currency, please let us know so we can confirm the amount payable.

(b) Please ensure that any additional transfer fees are covered by you.

(c) £400 is due initially to secure your booking. This is non-refundable.

(d) Cancelations prior to March 1, 2022 will receive a refund of monies paid, less the £400 deposit. 
(e) 100% of your booking bill must be paid on or before April 1, 2022. 

(f) Cancelations after March 1, 2022 will receive 50% refund (minus deposit). After this, they are non-refundable unless you are unable to attend due to reasons associated with COVID-19. These include not being able to travel to Portugal because of government-imposed restrictions (a mandatory quarantine period on either side would be reason enough) or if you have been diagnosed with the virus yourself. In the case of having the virus yourself, you will be required to provide proof of diagnosis in order to receive a full refund. If we are able to fill your spot, we may be able to refund you in other circumstances, or allow you to transfer the deposit to a future retreat, but this is subject to our discretion.

(g) Payments can be made through Squarespace, Paypal, bank transfer or in cash.

3. Your Travel Arrangements

All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost, unless otherwise specified.

4. Travel Insurance

(a) We require each trip member to purchase individual travel insurance for their trip for both international escapes and domestic escapes. We suggest that you include “cancel for any reason” with your policy, as well as cancellation and medical cover for COVID-19 related incidents.  You must purchase travel insurance that includes medical coverage. We recommend you purchase insurance within 1-2 weeks after making your first trip payment (ie. flight or escape reservation) to secure the best price and best coverage. Clients are responsible at all times for their own personal documents, baggage and equipment, whether hired or not. You should bring the policy with you in case of an emergency.

5. Your Health

(a) It is your responsibility to let your Yoga Instructor know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

(b) It is also your responsibility to consult a doctor with an understanding of yoga to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may choose to do whilst on the retreat.

(c) Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats.

(d) Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.

(e) Women who are 12 to 28 weeks pregnant should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide. We would prefer pregnant women to have done a little yoga before they arrive.

(f) Our food will be prepared to the highest possible standards but food preparation carries with it inherent risks. It is your responsibility to advise the organisers of any food allergies or intolerances, at least one week before the arrival date. We do not accept any liability for illness caused by food consumption.

7. Cancellation by you

(a) You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us. If such cancellation is made after April 1, 2022, we will retain the entirety of your payment. However, if another person can be found to take your place, then we may offer you a refund at our discretion.

(b) Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.

8. Amendments by us

Occasionally, changes may have to be made (e.g. class times, venue or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

9. Cancellation by us

We reserve the right in any circumstances to cancel a retreat. In particular our retreats require a minimum number of at least 75% of the participants to have booked by 30 days before the start date. If this minimum number is not reached by that date we may cancel and refund the money to you. If we have to cancel the retreat after this date for any other reason (e.g. COVID-19 restrictions), you will receive a full refund of any amount that has already been paid.

10. Our liability to you

(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

(b) We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

(c) We are not liable for any injuries you may incur. Yoga classes are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

11. Group Bookings

Where a booking is made on behalf of several individuals the booking is conditional on the person(s) paying having authorisation from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their own retreat individually and directly to us.

12. No Liability for possessions

(a) It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment.

13. Complaints

If you have a problem during your retreat, please inform the organiser immediately and he/she will endeavour to put things right. Please note that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.

14. Privacy Policy

We do not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.

15. Photography

I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorise ELIZABETH DIPRE to use photographs of me and or my property and authorise her and her assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or studio name here. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release. 

YOGA STUDENT WAIVER AGREEMENT

I understand that yoga requires and includes physical movements. I realise that yoga also provides relaxation, stress relief, stress education and awareness. As with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will notify the instructor, adjust my posture and listen to my body. I will not push my body too far and will ask for support from the teacher if needed.

Yoga is not a substitute for medical care or diagnosis. Yoga can work well in conjunction with traditional medical care. I will practice yoga only after discussing it with my doctor and gaining their approval. I affirm that I alone am responsible to decide whether to practice yoga. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against ELIZABETH DIPRE.

I, hereby agree to the following:

1. That I am participating in yoga classes offered with ELIZABETH DIPRE, where I will receive information and instruction about yoga. I understand that yoga requires physical exertion which may be strenuous and may be strenuous and may cause physical injury. I am fully aware of the risks involved.

2. I understand that it is my responsibility to consult with a physician prior to and in reference to my participation in yoga classes. I warrant and represent that I am physically fit and have no medical condition that would prevent my full participation in yoga.

3. In consideration of participating in yoga, I agree to assume full responsibility for any risks, injury or damages, which I might incur as a result in participating yoga.

4. I knowingly and voluntarily waive any claim I might have against ELIZABETH DIPRE for injury or damages that I may sustain as a result of participating in this program.

5. I, my heirs or legal representative forever release, waive, discharge and covenant not to sue ELIZABETH DIPRE for any injury or death caused by their negligence or other acts.

I have read the above release and waiver of liability and I fully understand its contents. I fully and voluntarily agree to the above terms and conditions.


ADDITIONAL INFO RELATING TO COVID-19

Any payments made are non-refundable after April 1, 2022, unless you are unable to attend due to reasons associated with COVID-19. These include not being able to travel to Portugal because of government-imposed restrictions such as a mandatory quarantine on either side or borders being closed to your country of origin. If you are traveling from the UK, Portugal being on the “amber list” does not qualify as a mandatory quarantine since this does not apply to fully vaccinated travelers. The latest date to cancel due to government-imposed restrictions relating to COVID-19  is April 1, 2022. No deposits will be able to be refunded for cancellations made after this date, other than if you have been diagnosed with the virus yourself within 14 days of the retreat start date. In this case, you will be required to provide proof of diagnosis in order to receive a full refund. 

If we are able to find another guest to fill your spot, we may be able to refund you in other circumstances, or allow you to transfer the deposit to a future retreat, but this is subject to our discretion.

During our retreat, we will be complying with all safety and protection from COVID-19 guidelines as they are set in Portugal at that time. Cleaning and disinfecting products will be provided as necessary, as will hand sanitiser. The group of guests will be max 16 people and everyone will be required to sign a waiver upon arrival to state that they do not have COVID-19 or symptoms and that they have not, to their knowledge, been in contact with anyone that does for the past 14 days. 

Proof of a negative PCR test or the vaccine may be a requirement - this will be confirmed closer to the time. All guests are required to have their own travel insurance and we highly recommend that you purchase cover for COVID-19 related cancellations and/or infection.

If the retreat has to be cancelled by us for any reason, any deposits will of course be refunded in full. We are very optimistic that all COVID-19 related restrictions will have been lifted by the retreat start date, but we recommend that you book flexible flights just in case of unexpected circumstances.
